Introduction

Thank you for visiting NOORD. We create products to enhance your website building experience. Please read these Terms of Service as you must agree in order to have permission to use our Service.

Definitions

  • “Agreement” refers to these Terms of Service;
  • “Service” refers to the services that we provide, including our Shopify themes (whether obtained from us via Shopify, our Site, directly via e-mail, or otherwise) and our Site itself;
  • “Site” refers to our website, https://noordthemes.com/;
  • “NOORD” refers to our company; our Site; our Service; or a combination of all or some of the preceding definitions;
  • “User” refers to anyone who uses our Service, including general visitors to our Site;
  • “You” refers to you, the person who is entering into this Agreement with NOORD.

What We Offer

NOORD is an online company that creates Shopify themes. Currently, we sell these themes exclusively on Shopify.com (“Shopify”). Shopify controls the transaction, pricing, support policy and manages the license for each purchase.

NOORD offers technical support to anyone who buys our theme from Shopify. This support is offered on our company website, located at https://noordthemes.com/help-center and the support policy is controlled by Shopify.

When a User buys our theme from Shopify, they receive a Shopify purchase code which allows them to sign up at our support center to access our support. We only offer support to verified buyers of our theme from Shopify. We have a team of support gurus who manage our support services and interact with Users.

Eligibility

In order to use our Service, you must meet a number of conditions, including but not limited to:

  • You must not be in violation of any embargoes, export controls, or other laws of the Emirate of Ajman in the United Arab Emirates or other countries having jurisdiction.
  • You must be the minimum age required to enter into a contract in the area in which you reside (not less than 18 years of age). If signing up on behalf of an organization, you must be authorized to bind it to this Agreement.
  • You must provide us with personal information that we deem necessary to provide you with our Service.

Nature of Service

NOORD offers templates but makes no representations, warranties, or endorsements about the content displayed using such templates. You acknowledge that NOORD does not endorse the content of any website which uses its templates and you agree to release us from any liability arising from the acts or omissions of any of our Users.

Rules of Use

You must not:

  • Violate the laws of the Emirate of Ajman, the UAE, or any foreign political entity having jurisdiction.
  • Post or send anything violent, threatening, pornographic, racist, hateful, or otherwise objectionable.
  • Infringe on anyone’s intellectual property rights, defame anyone, or impersonate anyone.
  • Hack, crack, phish, SQL inject, or otherwise compromise the security or integrity of the NOORD Site.
  • Our Copyright: You agree not to copy, distribute, display, or otherwise reproduce any information on the Site without prior written permission.
  • Your Copyright: Whenever submitting content (photos, videos, text, audio) to our Site, you grant us a non-exclusive, universal, perpetual, irrevocable, sublicensable, and commercial right to use, distribute, sell, and publish it. You warrant that you have the right to grant this license and will indemnify us for any breach of this warranty.
  • Infringement Claims: If you believe your copyright has been infringed, please send a signed notification to our Copyright Agent at https://noordthemes.com/contacts/ including your name, a description of the work, and its location on our site.

Representations & Warranties

We make no representations or warranties as to the merchantability of our service or fitness for any particular purpose. You release us from liability for failure of our service, negligence, or any other tort. To the extent that law restricts this release, we are only liable for the minimum amount of damages allowed. We are not responsible for damages caused by third parties, including intellectual property infringement or defamation.

Indemnity

You agree to indemnify and hold us harmless for any claims arising from your use of our Site or Service. This includes a duty to defend us and pay for reasonable attorneys’ fees and court costs. We may elect to settle such claims, and you shall be liable for the damages as though we had proceeded with a trial.

Force Majeure, Severability & Non-Waiver

  • Force Majeure: We are not responsible for events beyond our control (acts of God, war, labor shortages, infrastructure failure, etc.).
  • Severability: If any provision is found unenforceable, the rest of the Agreement remains in force.
  • Non-Waiver: Our non-enforcement of any provision is not a waiver of our right to enforce it in the future.

Choice of Law & Forum

This Agreement shall be governed by the laws in force in the Emirate of Ajman. The offer and acceptance of this contract are deemed to have occurred in the Emirate of Ajman.

Amendments & Termination

We may amend this Agreement at any time by updating this page. We reserve the right to revoke permission to use our intellectual property or Service at our discretion. You may not assign your rights under this Agreement without our written consent.

Refund Policy

According to Shopify rules, theme refunds are not allowed due to the inherent nature of digital products:

  • Instant Access: Digital files are delivered immediately, making refunds difficult to enforce.
  • Intellectual Property Protection: To prevent unauthorized distribution or misuse of the developers' work.
  • Customization Potential: Once downloaded, there is no guarantee the customized version will not be used, making refunds impractical. We recommend researching themes via demos and documentation before purchase.
